The Hotels2Go.com.au Website is owned by Hotel Marketing Group Pty Ltd ABN 59 111 673 960  t/a Hotels2Go.com.au registered in Queensland, Australia.

1. This document sets out the Terms and Conditions (“Terms & Conditions”) under which you may use this Site.
2. Please read the Terms & Conditions carefully.
3. If you do not accept the Terms & Conditions stated in this document you should not use the Site or any of the services offered by the Site or its Suppliers.
4. By using the Site, you are indicating your acceptance to be bound by these Terms & Conditions.
5. The Site displays information and inventory added by Suppliers, including, but not inclusive of, Hotel and accommodation information, room information, promotions, rates and so forth.
6. All of the information is supplied to the site by third parties known as "Suppliers" Even though we take due care to ensure that information is correct and current, we cannot check the accuracy of all third party information.
7. We therefore accept no responsibility for information supplied to us by third parties.
8. Suppliers may change their prices, rates information or services, and other information displayed on the Site at any time without notice. Therefore, all information displayed on this Site is subject to change without notice.
9. The rates set out on the Site may not include taxes, airport charges, duties, transfers or incidental charges such ( but without limitation) meals, extra bedding, equipment hire etc.

Booking & Refund Conditions

• Hotels2Go.com.au facilitates the sale of rooms between Hotels (‘suppliers’) and guests (‘you’) Hotels2Go.com.au does not manage inventory or rates advertised on this site directly and accepts no liability for errors or omission.
• Bookings are made on a deposit basis. Hotels2Go.com.au will inform the supplier of your reservation which must be completed directly with the Supplier in the manner prescribed by the Supplier in their terms and conditions and supplied to you via your booking form.
• Deposits for booking processed via the Hotels2Go.com.au Website must be made in full prior to the booking being accepted for processing and notification to the Supplier.
• Payment is made via the PayPal/bank gateway. The gateway acts will notify Hotels2Go.com.au automatically when cleared payment is processed. In the event of failure of the gateway system payments can be made directly to Hotels2Go.com.au using credit cards using Amex, Visa or MasterCard.
• Hotels2Go.com.au accepts no liability or cost should such a delay, or any other delay, result in the selected room/s being sold to another party or the room being withdrawn from sale.
• Deposit fee are made directly to Hotels2Go.com.au and are dealt with under Hotels2Go.com.au terms and conditions.
• Bookings are considered pending by the supplier up until payment has been made in full and in cleared funds to the supplier according to their published terms and conditions contained on the site and in the booking form. Please read the supplier refund and cancellation policies.
• The Supplier Booking fee does not include additional or incidental charges for extra guests, children, or the hire of additional beds, bedding, cots or other services provided by the supplier, meals or any other costs that may be charged separate to the total booking fee advertised on the Hotels2Go.com.au site. These charges must be paid directly to the Supplier.
• Room rates advertised on the Hotels2Go.com.au website are published by the suppliers. The inclusion and advertising of Incidental charges is the sole responsibility of the supplier. Suppliers reserves the right to update fees and incidental charges up to and including the day of check in.
• Hotels2Go.com.au reserves the right to charge you a fee for each variation or cancellation to a booking once that room has been booked and a deposit made. In addition the Supplier reserves the right to charge you a separate fee for cancellations and variations.
• Hotels2Go.com.au fees: Cancellation fee $25AUD . Variation fee $25.00 AUD. Hotels2Go.com.au reserves the right to change or update these fees with notification.
• Hotels2Go.com.au.com will not refund deposits for bookings which are not redeemed for any reason including those beyond your control such as injury, industrial actions or acts of God.
• The booking surcharge is non refundable.
• This agreement and the Hotels2Go.com.au site are governed by the laws of Queensland, Australia.
• You irrevocably submit to the exclusive jurisdiction of the courts of Queensland, Australia, and courts of appeal from them, for determining any dispute concerning this agreement.
• Hotels2Go.com.au is an advertising site and is not a licensed travel agent and does not offer any travel related service. The Supplier is the booking agent.
• Please read our Privacy Policy concerning the collection and storage of your personal information used for the purpose processing of your bookings with suppliers and use of the Hotels2Go.com.au site.
• By checking the box on the booking form you agree and accept the terms of this agreement.

Intellectual Property

10. The material contained on the Site, including (without limitation) the software, design, text and graphics and information is protected by copyright and patents.
11. except to the extent permitted by the law and the relevant copyright legislation, you must not use, copy, modify, transmit, store, publish or distribute the material on the Site, or create any other material using the material on the Site, without obtaining our prior written approval.

You must not use:

10. Use any device, software or routine to interfere or attempt to interfere with the proper working of the Hotels2Go.com.au Website or any transaction or process being conducted on or through it.
11. take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Hotels2Go.com.au Website.
12. Reverse engineer or otherwise attempt to discover source code or other formula’s in respect of the software underlying the infrastructure and processes associated with the Hotels2Go.com.au Website.
13. Trademarks (registered or unregistered) and logos must not be used or modified in any way without obtaining our written approval.
14. The Site, the products and services offered on the Site, the technology and processes used by the Site and all other material contained on the Site may be the subject of other intellectual property rights. No license is granted in respect of those intellectual property rights other than as set out in these Terms & Conditions.
15. Your use of the Site must not, in any way, infringe the intellectual property rights of any person.

17. The Site may contain links to the other Websites belonging to third parties (“external Website”). We are not required to maintain or update either the external Website or the links to the external Website.

Links to external Website should not be considered in any way as an endorsement , recommendation or preference by us of - or the owners or operators of the external Websites; or the information, content, products or services referred to on the external Websites, unless expressly indicated otherwise on the Site.
19. We make no warranties and accept no liability in relation to information or material contained on external Website.
    

Your Use

20. You must only use the Site for lawful purposes, in a responsible manner and for the purpose intended.
21. We will take legal action against you if you breach any of these Terms & Conditions.

You must not:

25. Breach any third party’s rights (including a third party’s intellectual property rights, or confidentiality owed to a third party) or infringe any laws in any jurisdiction in using and/or accessing the Site.

28. Knowingly permit another person to do any of the above acts.

Your Warranties

You acknowledge and warrant that:

By logging onto the Site, you release and discharge us, our subsidiaries and all of our officers, employees and agents from:

24. any consequential, exemplary, incidental, special or punitive damages, including (but not limited to) lost profits which might arise resulting from your access to, use of or inability to use the Site.
25. We, our subsidiaries, our officers, our employees and our agents are in no way liable for any loss or damage incurred by you in any way by your access to, use of or inability to use the Site and
26. The products and services offered and promoted via the Site are products and services of third parties and the Site are used to facilitate your purchase of those products and services. Your legal relationship in respect of the third party products and services that you purchase via the Site will always be with the relevant third party provider and you shall have no recourse in respect of same against us, our subsidiaries, our officers, our employees and/or our agents.

Indemnity

You agree to indemnify us, our subsidiaries, our officers, our employees and our agents against all losses, costs, damages and claims in respect of any:

26. Claim, action, demand or proceeding by a third party against us, our subsidiaries, our officers, our employees or our agents, which claim action, demand or proceeding has been contributed or caused by you in any way, or by an officer, employee or agent of you, in any way.

Disclaimers & Limitation of Liability

Except where to do so would cause any part of these Terms & Conditions to be illegal, void or unenforceable:

25. Your access to and use of the Site is subject to factors beyond our control. We do not represent or warrant that the Site, the servers that make the Site available or any of the products and services supplied through the Site are free from any errors, viruses, defects or that the service of the Site will be uninterrupted or timely;
26. We will not be liable for any disruptions to the Site;
27. We cannot ensure that any files or information you download are free from any viruses or from any contamination or destructive features;
28. We shall not be liable to you or to anyone else if interference with or damage to your computer systems occurs in connection with the use of the Site or an external Website. You may instruct us at any time not to use your personal information to by contacting us here. Please note that this process may take up to thirty (30) days to complete. This privacy policy does not cover third-party information practices. Credit Card numbers are NOT stored in any form by Hotels2Go.com.au on any internal or external databases. 37. We may disclose aggregated information about users of the Site and use statistics relating to the Site and aggregate information about our sales and trading patterns to third parties.

Amendments

38. We may amend these Terms & Conditions at any time and without notice to you, by posting an amendment or revised and/or updated Terms & Conditions on the Site.
39. The amended Terms & Conditions will take effect immediately when they are posted on the Site.

Termination

40. We may terminate this agreement or your ability to access the Site and/or any other services requested from you by us immediately if you breach any of these Terms & Conditions.
41. If any dispute arises about this agreement or how this agreement applies or arising out of your use or misuse of the Site, the laws of the State of Queensland, in Australia, will apply.
42. 1You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of the State of Queensland, Australia and you waive any right that you may have to object to an action being brought in those courts.

Invalid Terms

43. Where any part of the Terms & Conditions is invalid or unenforceable, it may be severed without affecting any other part of the Terms & Conditions.

Waiver

44. If we do not act in relation to a breach by you or by other of these Terms & Conditions, this does not mean we waive our right to act in relation to subsequent or similar breaches.
